Disability Management ProgramTM
Over the last decade, employers large and small have struggled to understand the very complex and technical requirements of the Americans with Disabilities Act (ADA).

I. HOW TO IDENTIFY AN EMPLOYEE OR APPLICANT WITH A DISABILITY

What is a “physical or mental impairment” that “substantially limits” one or more “major life activities”? Does the individual have a “record or history” of a substantially limiting impairment? Is the individual “regarded as” having such an impairment?

II. HOW TO DETERMINE WHETHER A DISABLED INDIVIDUAL IS QUALIFIED FOR THE POSITION

Identifying the prerequisites for the job and its essential functions; gathering relevant information from the individual’s healthcare provider regarding any limitations the disability imposes; assessing whether the individual’s disability poses a direct threat to self or others.

III. HOW TO PROVIDE REASONABLE ACCOMMODATION FOR DISABLED INDIVIDUALS

Is there a way to enable a qualified individual with a disability to perform the essential functions of the job and enjoy equal benefits and privileges of employment by modifications to equipment or the facility, restructuring the job, changing the work schedule, or granting a short-term leave of absence?
