Disability Management ProgramTM
Over the last decade, employers large and small have struggled to understand the very complex and technical requirements of the Americans with Disabilities Act (ADA).
Developed under the guidance of Michael Faillace, a nationally known expert on the ADA, our Disability Management ProgramTM allows even small organizations without sophisticated HR functions or in-house legal departments to work through the required analysis in a logical way and, thus, avoid exposure to expensive, damaging and time-consuming claims of discrimination.
I. HOW TO IDENTIFY AN EMPLOYEE OR APPLICANT WITH A DISABILITY
What is a “physical or mental impairment” that “substantially limits” one or more “major life activities”? Does the individual have a “record or history” of a substantially limiting impairment? Is the individual “regarded as” having such an impairment?
II. HOW TO DETERMINE WHETHER A DISABLED INDIVIDUAL IS QUALIFIED FOR THE POSITION
Identifying the prerequisites for the job and its essential functions; gathering relevant information from the individual’s healthcare provider regarding any limitations the disability imposes; assessing whether the individual’s disability poses a direct threat to self or others.
III. HOW TO PROVIDE REASONABLE ACCOMMODATION FOR DISABLED INDIVIDUALS
Is there a way to enable a qualified individual with a disability to perform the essential functions of the job and enjoy equal benefits and privileges of employment by modifications to equipment or the facility, restructuring the job, changing the work schedule, or granting a short-term leave of absence?
Employment Law Compliance’s Disability Management ProgramTM helps you understand these terms of art, and guides you through the steps that ensure not only compliance with technical legal standards, but allow you to maintain a productive workplace and minimize “downtime”.
In addition, the Disability Management ProgramTM contains the following:
- “Special Issues” Section - How to deal with disability discrimination claims; employees with alcoholism and drug addiction problems; pre-employment or return-to-work medical examinations; and independent contractor relationships.
- Forms Section - A comprehensive collection of forms, checklists and template documents that support each part of the disability management process. Use these documents to gather information from healthcare providers, and to document communications with the disabled individual and others.
- Manager Awareness Program - It is essential to educate managers about their important role in maintaining compliance with the ADA and other laws affecting the workplace. Employment Law Compliance has designed a complete training module including an engaging PowerPoint® presentation, a facilitator’s guide, bank-specific case studies, and a comprehension test.
The Disability Management ProgramTM is provided in hard copy and on CD. It is formatted in Microsoft Word® (training slides are in Microsoft PowerPoint®), permitting the user to quickly and easily customize, integrate, and electronically disseminate the contents. Periodically, ELC will provide updated content to reflect any relevant legal and HR best practices developments. These updates are free during the first year.
