Interchange: Fed Won't Meet April 21 Deadline

Citing volume, complexity and the need for thorough review associated with more than 11,000 comment letters on its debit-card interchange price cap proposal, the Federal Reserve this week said it would not meet the April 21 deadline for finalizing the rule, as mandated by the Dodd-Frank Act. Federal Reserve Chairman Ben Bernanke communicated that to U.S. Senate and U.S. House leadership by letter this week. Read Bernanke's letter and write your own to your member of Congress...

 

Legislature in Session Four Days This Week

Legislators spent much effort this week trying to develop a tax package that would be both revenue neutral while creating new jobs and making Georgia more competitive in attracting new businesses. Negotiations will continue during the recess next week. The legislature has three more days to meet, currently set for Apr. 11, 12 and 14. While the tax reform bill got most of the attention in the media, GBA has been working with Legislators to perfect a number of bills that received attention this week. 2011 Annual Convention is Approaching Fast!

The final touches are being put on GBA's 2011 Annual Convention scheduled for June 20-201 at The St. Regis Hotel, Atlanta. Mortgage Originator Comp. Rule Kicks in April 1

A new rule governing mortgage originator compensation goes into effect April 1. The rules were discussed in detail this week at GBA's Compliance Peer Group meeting in Macon by Brad Washburn, Steve H. Powell and Company. The rule is intended to provide consumer protections by prohibiting mortgage originators of covered loans (including bank loan officers) from receiving dual compensation directly from the consumer and any other person, or being paid more to steer customers into higher priced loans when loans at lower rates are available. Mortgage Risk-Retention Rule Proposed

We got our first look this week at proposed rules for how regulators will require sponsors of mortgage and other asset-based securities to retain at least 5 percent of the credit risk of the securities assets. Included in the proposed rule are general underwriting standards and definitions for how loans will qualify for exemption from the rule. Fed Doubles Threshold Amounts for Credit Transactions, Loans Covered Under Reg Z & Reg M

The Fed last week adopted two final rules expanding coverage of consumer protections in Reg Z--Truth in Lending (TILA) and Reg M--Consumer Leasing Act (CLA) to consumer credit transactions and leases up to $50,000. Currently, consumer loans above $25,000 are generally exempt from TILA and CLA. Read more details about the change in credit and lease threshold amounts…

 

SBLF Application Deadline for C Corps. is May 16

The Small Business Lending Fund has established May 16 as the application deadline for C corporations. Eligible institutions should submit their applications as soon as possible to allow sufficient time for processing. For S corporations, mutual institutions and Community Development Loan Funds, separate application deadlines will apply. We'll have more details soon. Temporary 504 Refinancing Program
Begins Next Week

A recent change to the application deadline will allow more small business owners with eligible commercial real estate mortgages maturing after Dec. 31, 2012, to secure more stable, long-term financing and avoid potential foreclosure on mortgages that were based on inflated real estate values through the SBA's temporary 504 refinancing program. Action Needed:

Address Change for FDIC's Consumer Response Center

FDIC has announced a change in address for its national Consumer Response Center within the Division of Depositor and Consumer Protection. The change requires all FDIC-supervised financial institutions to update their Adverse Action Notice forms and Fair Housing poster notices as soon as practicable.
