Georgia Supreme Court Affirms Problematic Garnishment Ruling

As we have recently reported, the State Bar of Georgia’s Standing Committee on the Unlicensed Practice of Law recently issued an advisory opinion stating that a "nonlawyer who answers for a garnishee other than himself in a proceeding pending in a Georgia court of record is engaged in the unlicensed practice of law." The Georgia Supreme Court unfortunately upheld that opinion this week. Insurance License Requirements for Employees Clarified by Insurance Commissioner and DBF

In a more positive development, the Georgia Insurance Commissioner has provided helpful clarification recently about insurance license requirements for bank employees. Several member banks have relayed their frustration over FDIC exam results requiring that each loan officer in a bank have an individual insurance license to include credit life insurance as part of a loan package. The DBF requested some clarification about the issue. The recent response that the DBF received from the Insurance Commissioner is a positive development and says that bank employees may continue to include credit life insurance in customer loan packages, and add those customers to a bank’s master policy, without requiring the bank employees to obtain a Georgia insurance license, so long as no fee or commission is paid to the bank employee. Second and Third Georgia Banks Approved for Small Business Lending Fund Investments; DBF Wants to Know Why Others Weren't Approved

On Wednesday, The U.S. Department of the Treasury announced investments in 61 more community banks of $608 million from the Small Business Lending Fund. Atlanta-based Resurgens Bank, President and CEO, Charles DeWitt, has received nearly $3 million and The Peoples Bank of Talbotton, Richard Skates, CEO, and Henry Persons, President, has received $890,000. Georgia DBF Commissioner Rob Braswell has asked Treasury Secretary Geithner why other qualified Georgia banks were not approved. "President Obama should acknowledge that something is seriously wrong with the government's response to the financial crisis of 2008 and chart a new course," says Bill Isaac, former chairman of the FDIC in a Sept. 7 opinion article for American Banker. How New Appraisal Reporting for GSE Loans Affects Banks

Residential appraisal reporting changed as of Sept. 1, for all appraisals being completed for loans being sold to Government-Sponsored Enterprises (GSEs) such as Fannie Mae and Freddie Mac. More than 80 percent of all residential appraisals are for loans being sold to the GSEs, so these rules will apply to most loans. State Jobs Outlook: 15 Percent Look to Hire More

Across Georgia, 15 percent of employers look to increase employment from October through December, while 9 percent expect to reduce staffing, for a 6 percent gain in the net employment outlook according to an employment survey by Milwaukee-based Manpower Group. Industries where job prospects appear strongest for the fourth quarter are construction, durable goods manufacturing, wholesale and retail trade, information, financial activities, professional and business services, and education and health services. FDIC's Temporary Jacksonville Office to
Remain Open through 2013

The FDIC expects its temporary Jacksonville, FL, office to remain open until at least the fourth quarter of 2013 because of work related to bank closures in the region. The agency noted that expectation in an announcement this week that it will close a similar office in Schaumburg, IL, on Sept. 28. Any remaining work being handled by the Schaumburg office will transfer to FDIC's Dallas office. Read more news about FDIC starting to shutter its satellite offices...

 

New Debit Card Rule FAQs Issued

There is a new set of explanations about how and if certain prepaid debit cards are exempt from the new debit card interchange pricing rules. The Federal Reserve posted the new FAQs this week. Some of the information is related to how the exemptions are applied to cards used for payments through websites. The FAQs also clarify how issuers should allocate net compensation payments from payment-card networks as the rule goes into effect in the middle of a calendar year.
