ABA Insurance Program: Bond and D&O Coverage
The GBA-sponsored insurance program managed by
ABA Insurance Services, Inc. is a bank-owned
mutual insurance company managed by a board comprised
primarily of bankers. Since
inception, the program has insured over 4,000 banks. In
addition, the program has declared $67.5 million in
distributions to ABA member policyholders.

Interchange: Collins Amendment
Dashes Damaging Durbin Provision
Last week we told you about more efforts by Ill. Sen.
Richard Durbin
to limit interchange rates as part of the
2011 Financial Services and General Government Appropriations Bill.
As a good-news update, just after we went to press last week the Senate
Appropriations Committee approved an amendment striking Durbin's
interchange language from the legislation.

Mortgage Regs.: Dodd-Frank Provisions Significant, Will take
Time to Implement
A whole section of the Dodd-Frank financial reform bill is
dedicated to mortgages (Title XIV). Bryan Cave's John ReVeal
posts a thorough summary on the law firm's
web site about Dodd-Frank, but there are a few nuggets we
thought were important to point out. Many of the
details will be familiar to Georgia
bankers as they were in the original Georgia Fair Lending Act.

Georgia Community Bank Symposium Scheduled for Sept. 23
Heads
up South Georgia community banks: the Georgia Bankers
Association, along with the Langdale College of Business at
Valdosta State University, will host its first Community Bank
Symposium Sept. 23 on the university’s campus in Valdosta. This event will feature experts who will focus on the many
issues facing the banking industry today.
Topics include an economic outlook, regulatory issues and
trends, the potential impact of federal guarantees for community
banks’ small business lending programs, accounting and auditing
issues in key areas and much more.

Man Sentenced
to 39 Months for Role in Omni National Bank Scheme
Brent Merriell, 38, of Atlanta, was sentenced to 39 months
for making false statements to the FDIC and for aggravated
identity theft. Merriell took out millions of dollars in illegal
loans from Omni and will face five more years of
supervised release as part of the judge’s order.

Through the first half of the year, stats about the housing
industry show some significant improvement, but some serious
struggles remain.

Theft Hits Georgia Businesses
Scammers who are forging corporate identities to commit
financial fraud are active in Georgia, said detective Fran
Foster of the Duluth Police Department.

10 Consumer Complaints Include Fake Foreclosure Help
A survey recently conducted by several consumer groups identified the top
10 consumer complaints
for 2009. Complaints about credit and debt were second on the
list of categories, and complaints about phony offers to save
consumers' homes from foreclosure were the fastest-growing
complaint for the year.

Fed Raises Fee Threshold
for Loan Disclosures
The Federal Reserve last week raised the dollar amount of the
fee-based trigger that imposes additional disclosure
requirements under the Truth in Lending Act and Home Ownership
and Equity Protection Act for mortgage loans. Beginning Jan. 1,
2011, the trigger amount will be $592.

Agency Decisions
Got a beef with the OCC? The OCC reminds national banks that its
Office of the Ombudsman's national bank appeals process is in
place for national banks that disagree with agency decisions.
