Whaley Named GBA Chairman
Rick
Whaley,
President and Chief Executive Officer of Citizens Bank of
Americus, has been named Chairman of the Georgia Bankers
Association. As defined in the GBA bylaws, Rick assumed the
Chairmanship upon the resignation of Chuck Williams,
president and CEO, North Georgia Bank, Watkinsville.
You'll recall that Chuck and Rick were installed as GBA’s
Chairman and Chairman-Elect at the annual meeting earlier this
year.

Attorney General Joins Mortgage-Servicing Investigation
Thurbert Baker,
Georgia's Attorney General, joined his counterparts nationwide
in an all-state investigation of mortgage-servicing policies and
procedures for foreclosures. At a news conference this week,
Attorney General Baker reminded the media that the foreclosure
process in Georgia is a simple, efficient process that allows
homeowners and lenders time to work out problems, but does not
require court oversight unless the lender chooses to pursue a
deficiency.

Interchange Update: Constitutionality of Durbin Amendment
Challenged
TCF National Bank this week filed suit challenging the
constitutionality of the Dodd-Frank Act's Durbin Amendment.
You'll recall that the Durbin Amendment orders the Federal
Reserve Board to enact regulations that strictly limit the
amount of interchange fees a bank can charge retailers on
debit-card transactions.

Registry Takes Effect Oct. 27
Just a reminder that the required registry of foreclosed
properties put into place by the DeKalb County Commission a few
months ago will take effect on Oct. 27.

Implements Maximum Size Increases on Numerous Loan Types
The SBA late last week implemented provisions in the
recently-signed small-business lending bill (H.R. 5297) that
permanently increase the maximum size of 7(a) loans from $2
million to $5 million for the 7(a) guarantee program. The bill
also provides a $505 million allowance for the SBA to extend its
temporary 90 percent guarantee and waive fees on 7(a) loans
through Dec. 31, 2010.

Texas
Bank to Reimburse Consumers $32 Million for Overdraft
Program Violations
The OCC has entered into a
settlement with Woodforest National Bank, Texas, that
will require the bank to repay $32 million to consumers harmed
by the bank's overdraft program. A Civil Money Penalty of $1
million will also be paid to the U.S. Treasury.
