Legislature
to Convene Monday |
|
The
Georgia General Assembly returns Monday for the
second year of their two year session. Most observers think
broad policy issues will be the focus of the session:
water, transportation, education, taxes and statewide trauma
care. But don’t count out a number of industry-specific
issues being addressed. The Speaker of the House,
Glenn Richardson (R-Hiram), will be pressing to
shift school funding away from the ad valorem tax and to a
sales tax. Now scaled back from applying to all ad valorem
taxes and entitled “Georgia’s Repeal of Education Ad
Valorem Taxes (GREAT) Plan,” the bill also would
eliminate ad valorem taxes on personal use automobiles.

Because this legislation would also require an amendment to
the Georgia Constitution, the bill and companion
constitutional amendment language must pass both the House
and Senate by a two-thirds vote. The Governor and other
legislators are focusing on other tax relief measures such
as reducing taxes on senior citizens and freezing property
tax assessments. Championing the property tax assessment
freeze is Sen.
Chip Rogers (R-Woodstock) who chairs the
Senate Finance Committee. The amendment restricts
the rise in ad valorem tax increases to no more than 1% per
year and provides for local referendums to raise taxes
further. This legislation would also have to pass by a
two-thirds majority to put the amendment on the November
ballot. |

In
other legislative news this week, the State of Georgia
released a proposed water plan. With the drought continuing
to affect so much of the state, we expect water issues to
get significant attention in the Legislature. Addressing
traffic gridlock around metro-Atlanta and the need for
additional transportation infrastructure statewide will be
high on legislator’s minds. Continuing improvements in
Georgia’s educational system and establishing a statewide
trauma care
system
will be debated. Atlanta’s Grady Hospital is in serious
financial condition, and the Legislature has been asked to
step in. The Speaker is proposing a new fee on car tag
renewals to fund the trauma network. We are also beginning
to hear legislators talk about the need to restore the
payday lending industry in Georgia, so that issue could come
back this year. As the session proceeds, we will update the
Government Relations area of our website daily and
report weekly via this Bulletin about the important issues
affecting banking. |

GREAT
Plan Includes Bank Services |
|
As
mentioned above, Speaker Richardson is pressing the
Legislature to replace the ad valorem tax funding for
schools with a state sales tax on services. In legislation
released this week, the banking industry was listed among
the businesses that would be asked to collect sales taxes on
their services. We are assessing the impact on our members
and will let Speaker |
|
Richardson
and other legislators know of any concerns. Clearly this
requirement would be an enormous and costly burden on banks
and we have been asked to testify before the
House Ways and Means Committee as they continue
their study of the concept. |

Nationwide
Mortgage Licensing System |
|
Legislation
will be considered this year to add Georgia to a recently
launched system to track mortgage lenders. |
|
The
Department of Banking and Finance is proposing the
bill to allow DBF to share information with other state
regulators. |
|

President/CEO Roundtables have proven to be a huge
success for sharing ideas and best practices among senior

Roundtable is composed of up to 12 senior executives

Advanced
Compliance Symposium Scheduled |
|
GBA will
host its annual
Advanced Compliance Symposium on February 26-27 at
the Idle Hour Country Club in Macon. The registration fee
for this two-day event is $295 per person and Steve Moore
with Bank Compliance Services, Avondale Estates is the
instructor. Day one will include an in-depth look at the
“new era” of Bank Secrecy Act compliance as well as several
interactive case studies involving more complex residential
mortgage loan transactions. On day two and back by popular
demand is the regulator panel discussion. Participants will
also review recent regulatory changes and the compliance
issues most frequently misunderstood by bankers on the
deposit and loan side of the bank. In addition, there will
be an in-depth discussion on how to audit or review for both
loan and deposit/operations compliance. |

ABA
Insurance Program Shares $5 Million In Profits With Member
Banks |
|
The
American Bankers Association has announced that the
American Bankers Professional and Fidelity Insurance Company
will distribute $5 million in underwriting profits to
insured member banks.
ABPFIC, the mutual reinsurer for the ABA-sponsored
insurance program, has distributed $63.5 million to
participants since 1991. The program – underwritten by
Progressive Casualty Insurance Co. and a Strategic
Partner of the GBA – offers directors & officers liability,
financial institution bond, Internet banking liability,
employment practices liability and other related insurance
products for community banks. Insured banks that are ABA
members are automatically mutual owners of ABPFIC.
