Passes Crossover Day - Several Bills of Interest Receive Action |
|
The
General Assembly passed the
30th legislative day of their session this week. The
significance of that day is that any bill which had not passed
either the House or Senate is technically dead for the session.
We say "technically" because a bill could always get tacked onto
legislation that is moving, so just about everything is still in
play. GBA publishes a weekly
Legislative
Update giving our members the latest information about the
legislation we are monitoring on your behalf. Today's

Chairman
Frank Announces Major Legislation Aimed at Foreclosures |
|
House Financial Services Committee Chairman
Barney Frank has announced his intention to introduce
far-reaching legislation which in his words would, “stem the
significant rise in mortgage foreclosures by allowing the
Federal Housing Administration (FHA) to insure and guarantee
refinanced mortgages that have been significantly written down
by mortgage holders and lenders.” Mr. Frank’s bill was still
being drafted at press time, but the major component of the
legislation would require a lender to take a substantial
discount on a distressed loan prior to the loan being refinanced
with an FHA lender. |

The
legislation would also provide $10 billion in loans and grants
to certain state housing authorities to work in concert with
local governments to purchase and rehabilitate vacant,
foreclosed homes with the goal of having the homes occupied as
soon as possible. While no firm date has been set for committee
consideration of his proposal, Mr. Frank has shown the ability
to quickly pass legislation through his committee and through
the House. |

Credit
Union Hearing Held in DC Last Week |
|
The
House Financial Services Committee held a hearing last week
on legislation sponsored for the benefit of Credit Unions. The
misnamed
Credit Union Regulatory Improvements Act, H.R. 1537, is
certainly much more than a regulatory relief bill. In fact, the
legislation would allow credit unions to stray even further from
their mission of serving low and moderate income individuals;
expand credit unions’ ability to offer multi-million-dollar
tax-subsidized loans to businesses and corporations, which was
not Congress’ intent when it granted a taxpayer subsidy to these
institutions; and would lower capital standards for credit
unions, thus raising safety and soundness concerns. |

you share GBA’s concerns with this legislation and how it would
give credit unions a greater unfair advantage than they
currently enjoy, please let your own member of Congress know.
Credit Unions had thousands of members on Capitol Hill this week
and bankers must respond in similar numbers. Otherwise, members
of Congress will certainly think this issue is not important to

Sen.
Dole Introduces Sarbanes-Oxley Relief Legislation |
|
Sen.
Elizabeth Dole (R-NC) has introduced the
Regulatory
Relief and Fairness Act, S. 2703, that would allow qualified
insured depository institutions to voluntarily opt out of
preparing Section 302 certifications and Section 404 internal
control management reports and auditor attestations required by
the Sarbanes-Oxley Act. Dole said the costs of these
requirements, while well intentioned, outweigh the benefits. GBA
past-chairman, Dan Blanton, CEO of
Georgia Bank and
Trust Company in Augusta and Vice Chair of the
American
Bankers
Association Community Bankers Council applauded the introduction of this legislation. “These well-meaning
regulations |

simply cannot be justified sometimes for the
supposed benefit derived from them. I had the opportunity to
testify before the Securities and Exchange Commission when they
were looking into the value of these regulations, and told them
that for many banks, the Section 404 regulation has been one of
the most costly requirements ever adopted because it involves extensive
testing and documentation. I also told them that much of this
information is already required by the FDIC Improvement Act.
Hopefully Sen. Dole's bill will pass soon to give some much
needed relief,”

Credit
Conference Mid-Year Update Scheduled |
|

current issues facing bank management today's volatile economy, it
is crucial to
keep abreast of vital information needed to survive the
challenges and prepare for growth as the economy recovers. In
