Winding Down - Six Legislative Days Left in Session |
|
The
General Assembly
will be in recess until next
Thursday, March 27. The legislators have six legislative days
remaining in the 2008 session to complete their work. The major
hold-up to their adjourning is the adoption of the 2009 budget,
and we expect them to make progress on that next week. GBA publishes a weekly
Legislative
Update giving our members the latest information about the
legislation we are monitoring on your behalf. Today's

FDIC
Raises Questions about Increasing Municipal Insurance Coverage |
|
We haven’t
heard much recently about the idea to increase deposit insurance
coverage for municipal and other government deposits. However,
the FDIC has just released a study that raises significant
questions about the advisability of increasing this coverage.
The study was begun in 2006 and covered the range of both
private and public sector options for insuring the safety of the
deposit. The study reviewed a number of different options
states employ such as having various security pledging
requirements. Georgia is one of the few states, if not the only
state, that allows a bank to create a pool of securities to
pledge against all government deposits. |

The GBA has
contracted with the State of Georgia to manage the pledging
process to help banks ensure they collateralize their public
deposits adequately, but just as importantly, are not
over-collateralized. We also re-price the securities monthly
which is important in today’s volatile interest rate
environment. While the FDIC study does not oppose increasing
coverage, enough red flags were raised that would make
increasing coverage difficult: the possible need to raise
assessment rates, the “moral hazard,” and the increased exposure
of the FDIC fund itself. |

FDIC
Weighs-in Again on Commercial Real Estate |
|
The Federal Deposit Insurance Corporation (FDIC) has
issued a letter re-emphasizing the importance of strong capital
and loan loss allowance levels, and robust credit
risk-management practices for state nonmember institutions with
significant concentrations of commercial real estate (CRE)
loans, and construction and development loans. The Financial
Institution Letter,
Managing Commercial
Real Estate Concentrations in a Challenging Environment,
complements the principles articulated in the December 6, 2006,
CRE interagency statement. FDIC Chairman
Sheila C. Bair said, "It is a good time to re-emphasize
the 2006 guidance because a number of banks have significant CRE
concentrations, and the weakness in housing across the country
may have an adverse effect on those institutions. Banks with CRE
concentrations should take steps to strengthen their overall
risk-management framework and maintain strong capital and loan
loss allowances. We encourage institutions to continue making
commercial real estate and [C&D] loans available in their
communities using prudent, time-tested lending standards that
rely on strong underwriting and loan administration practices." |

Banks
in fast-growing states like Georgia have grown their CRE
portfolios in response to market demand, especially in
metro-Atlanta, our coastal communities and mountain retirement
areas. While some of these real estate-related loans are under
stress, mostly in the A&D categories, other commercial real
estate seems to be remaining fairly stable. “Georgia businesses
are continuing to grow jobs and our state is attractive to new
businesses,” said GBA Chairman Jim Williams, CEO of
Citizens Bank & Trust in Eastman. “We have not seen
housing price corrections in Georgia occurring elsewhere like
California, Florida and Nevada. Homeownership is affordable and
those with good credit can take advantage of the supply of homes
in today’s buyer’s market. For those of us outside these
high-growth markets, we are continuing to see demand from our
traditional borrowers; and commercial and consumer loan growth
is good,” Jim concluded. |

AIB Analyzing Financial Statements will be offered again beginning June 3 for 10
weeks. This class will be taught by Peter Faser of

CRA
Credit for Loans or Investment in the Senior Housing Crime
Prevention Foundation |
|
The Georgia
Bankers Association is proud to recognize the
Senior Housing Crime Prevention Foundation as a
Strategic Partner. The Senior Housing Crime Prevention
Foundation is a nonprofit organization based in Memphis that
offers banks a measurable, no-risk, high-yielding avenue for
gaining CRA credit. By making a loan or an investment with a
guaranteed return, banks receive credit for Community
Reinvestment Act (CRA) requirements. The foundation uses the
funds to set up
Senior Crimestoppers programs for nursing homes and
senior HUD housing units in the bank’s direct CRA assessment
areas. Banks also may reposition or recycle existing bonds in
their
portfolios
to capture the same effect, and in doing so create a |
|
new
annual CRA credit from bonds in the existing portfolios.
Banks may elect to invest or lend funds to the foundation and
will qualify for CRA credits either way. All dollars invested
in or loaned to the foundation are fully collateralized with
investment-grade bonds, which are selected with the bank’s input
depending on the degree of risk it wants to take. Banks are
guaranteed a return on the coupon value of the bonds minus
moderate basis-points spread to cover the cost of the
